TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your (the “Participant” or “you”) use of the Name.art website and platform (the “Service”) operated by UKCI Holdings (“.ART,’“we,” “us,” or “our”). By accessing or using Name.art, you agree to be bound by these Terms.
1. Overview of the Service
Name.art allows users to:
Register for an account
Earn, purchase, and use coins to mint referral tokens uniquely associated with available .ART domains. That is, each referral token is associated with one domain only and is the only token associated with that domain name, and only those domain names available for registration can have a token associated with it.
Receive rewards when the domain associated with their referral token is registered
Participate in promotions, loyalty programs, or other related activities made available by .ART
2. Eligibility
To use the Service, the Participant must:
Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater
Agree to these Terms and our Privacy Policy
Provide accurate registration information
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify us of any breach of that confidentiality or unauthorized access or use.
4. Coins and Referral Tokens
Coins are digital credits used within the platform. They are not fiat currency, legal tender, cryptocurrency, or securities.
Referral Tokens represent unregistered .ART domains and entitle the token holder to potential rewards if the associated domain is registered during the active token term. Each token is uniquely associated with one domain.
Referral Tokens are obtained through the procedure described in the program description found on the name.art webpage.[KP1] This procedure may change from time to time.
Coins and tokens have no cash value outside the platform and cannot be transferred, resold, or exchanged except as expressly permitted by .ART.
All coin transactions are final and non-refundable except where required by law.
5. Rewards
When a domain associated with your referral token is registered during its validity period:
You are eligible for a reward equal to 10% of the tier price of that domain.
Rewards are paid in stablecoin [KP2] to your connected crypto wallet once your total reward balance reaches at least $10 USD.
You may also receive bonus coins back (110% for successful referrals, 90% on expiry).[KP3]
.ART will, without input from Program participants, automatically calculate and distribute rewards due for domain registrations. If a reward is perceived to be due by the Participant but not received, the Participant may challenge .ART and .ART will thoroughly investigate the claim, which will check the existence of two facts and only those facts:
1. That the participant holds a token associated with the claimed registered name
2. That the domain name is registered, and
a. that registration occurred while the Participant held the valid token associated with that domain name at the time of registration, and
b. the registration has survived the 5-day Add Grace period.
6. Your Rights, Duties, and Prohibited Activities
You may:
• Use images, logos and prose on the .ART webpages in order to promote the utility and value of .ART domains. You must attribute the materials to .ART when shared. .ART-created
• Request the creation of promotional materials by .ART who will consider such requests along with other requests and needs, or work collaboratively with .ART on developing materials, or develop materials independently and obtain the approval of .ART of any materials that portray .ART, which will not unreasonably be withheld.
You must:
• Return all .ART created and owned materials to .ART upon the termination of your association with .ART.
• Always hold out .ART and its mission in a positive way
You agree not to:
Hold yourself out as an employee or business agent of .ART.
Use the platform for unlawful purposes
Interfere with or disrupt the Service
Attempt to manipulate rewards, exploit system vulnerabilities, or engage in fraudulent activity
Copy, modify, or “reverse-engineer” any part of the platform
Otherwise act to the detriment of or denigrate .ART or the NAME.ART Program.
Violation of these rules may result in suspension or termination of your account.
7. Intellectual Property
All content on Name.art, including logos, graphics, text, code, and trademarks, is the property of UKCI Holdings or its licensors and protected by intellectual property laws. You may not reproduce, distribute, or display any content without our prior written consent. All Intellectual Property in possession of the Participant must be returned to .ART at the end of the Participant’s participation in the project.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available.” UKCI Holdings makes no warranties, express or implied, regarding:
The accuracy or reliability of content or listings
Continuous availability of the platform
The suitability of domain names for any particular purpose
9. Limitation of Liability
UKCI Holdings shall not be liable for any indirect, incidental, or consequential damages arising from your use of Name.art, including but not limited to lost profits, data loss, or business interruption. Otherwise, in no case will damages exceed the value of rewards due in the Project.
The Participant agrees to indemnify .ART and hold it harmless against any and all liabilities, including judgments, costs and reasonable counsel fees, for anything done or omitted by the Participant in the participation in the Project,
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or misuse of the platform. Upon termination, unused coins or tokens may be forfeited without compensation.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Isle of Man, without regard to conflict of law principles.
